A BILL to amend article three, chapter sixty-four of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
one-a, relating to amending the public service commission,
tariff rules, legislative rules; relating to accelerated rate
procedures for gas, water and electric utilities.
Be it enacted by the Legislature of West Virginia:
That article three, chapter sixty-four of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section one-a,
to read as follows:
ARTICLE 3. AUTHORIZATION FOR BUREAU OF ENVIRONMENT TO PROMULGATE
LEGISLATIVE RULES.
§64-3-1a. Public service commission tariff rules; accelerated rate
procedure for gas, water, and electric utilities.
The legislative rule of the public service commission, tariff
rules, contained in title one hundred fifty, relating to
accelerated rate procedure for gas, water and electric utilities is
reauthorized with amendments, as follows:
On page eight of the published code of state rules, section
thirteen, by deleting subsection 13.2.1.
NOTE: The purpose of this bill is to amend the legislative
rules of the public service commission relative to accelerated rate
procedure for gas, water and electric utilities and eliminating
Rule 150-2-13.2.1 that allows a gas utility to apply for
adjustments in rates charged annually for the twelve-month period
from November 1 through October 31.
